Terms of service

These terms cover your use of this website and how Kaptured Creatives works with clients. By using the site or sending us an enquiry, you agree to them. If we sign a separate agreement with you, or you accept a quote with its own terms, those take priority for that project.

Using this website

You're welcome to browse, share links to and get in touch through this site. Please don't:

• use it for anything unlawful, misleading or harmful
• send spam, malware or other people's details through our forms
• try to break, overload or get around the site's security
• copy our work, text or images, or collect them with automated tools, to reuse, resell or train AI models

The work we show

The projects on this site belong to us or to our clients, and we show them with permission. Logos and trade marks belong to their owners. You may not reuse any of it without written permission.

Enquiries and quotes

• Sending an enquiry doesn't commit either of us to anything.
• Our quotes are valid for 30 days and cover only the work they list. Anything else is quoted separately before we start it.
• A project is booked once you accept the quote and pay the deposit. How payment works is set out in our payments and refunds policy.

Revisions and approvals

Each deliverable includes two rounds of revisions unless the quote says otherwise. A round is one combined set of feedback. Please check spelling, facts, prices and legal wording before you approve anything. Approval by email, chat or through our client links counts as written approval.

Your content

When you send us logos, photos, copy, music, data or login details, you confirm that you have the right to use them and that they don't break anyone's rights or the law. You give us permission to use them for your project only. We can decline content that is unlawful, hateful, defamatory, misleading or that infringes someone else's rights.

Please don't ask us to create work that copies someone else's brand, misleads people, or promotes anything illegal in Kenya. We may end a project that does.

Who owns the work

• We own the work until it's paid for in full.
• Once you've paid in full, you own the final approved deliverables, or receive the licence set out in your agreement.
• Sketches, concepts and options you didn't choose stay ours.
• Fonts, stock photos, music, templates and other third-party materials are covered by their own licences, which you may need to buy for your own use.

Showing your project

We may show finished work on our website and social channels, and enter it for awards, unless you ask us in writing not to or it's covered by a non-disclosure agreement.

Client links

We send invoices, quotes and documents as private links. Anyone with a link can open it, so please keep them private and tell us if one has been shared by mistake. Signing a document through one of our links is a valid electronic signature.

Confidentiality

We each keep the other's private business information confidential and use it only for the project.

Liability

We take care to keep this site accurate and available, but it's provided as it is, and prices and details may change. Our total liability for any project is limited to the fees you've paid us for it, and we aren't liable for indirect losses such as lost profits. We aren't responsible for problems caused by printers, hosting providers, platforms or other third parties. Nothing in these terms limits any right you have under the Consumer Protection Act, 2012 or any liability that can't legally be limited.

Links to other sites

We link to social networks, payment providers and other sites we don't control. Their own terms and privacy policies apply.

Disputes

If something goes wrong, please talk to us first at support@kaptured.co.ke and we'll do our best to put it right. These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction.

Changes

We may update these terms from time to time. The date at the top shows the latest version, and the version in place when you accepted a quote applies to that project.
